El passat 23 de setembre nou persones van ser detingudes. Set han quedat en presó preventiva a Madrid. Segons Alerta Solidària @AlertaSolidaria, les irregularitats són diverses. És urgent explicar-ho a l’estranger, i explicar la nostra versió. El moviment independentista sempre ha estat pacífic.

Dear Mr./Ms. Xxxx
My name is xxxxx, I am a Catalan citizen deeply worried for what is happening in my country. When repressive acts are the response peaceful people resistance is likely to happen.
Last Monday (September 23rd) nine members of the Republic Defence Committees (CDRs) were arrested by the Spanish police. This is another attempt (as Raphael Tsavkko Garcia @Tsavkko_intl explains in his article https://intpolicydigest.org/2019/09/26/while-eta-no-longer-exists-spain-finds-ways-to-further-criminalize-the-pro-sovereignty-movements-in-catalonia/) to intimidate and criminalise the Catalan pro-sovereign movement, on the eve of the trial sentences of the 12 political prisoners who will most likely be the maximum penalties for their prerogatives of calling a referendum for independence (October 1st, 2017) following the popular will of the Catalan people.
The operation was called by Spain’s National Court (Audiencia Nacional) https://en.wikipedia.org/wiki/Audiencia_Nacional as they considered it was a nationwide crime. The initial charges were Terrorism, Rebellion and possession of explosives, the latter was dropped after they realised they had only seized firecrackers from the local fiesta. But 7 of them have been sent to jail without bail accused of belonging to a Terrorist organisation.

Infringements of the Right to Counsel
During these two days, the defence team has suffered numerous difficulties intentionally exercised by several parties, the Guardia Civil, the prosecutor and the Audiencia Nacional that have caused serious violations of the rights of Catalan activists:
First of all, there have been leaks to the media of its own operations, alleged accusations, supposed elements found in the registry, etc.; in a case in which the defence cannot have access due to the fact the case is under seal.
On the other hand, it has been difficult for the team of lawyers to know where the detainees were, not informing them or providing them with contradictory information.
Lawyers have also found difficulties to interview the detainees delaying it for more than 36 hours while they were under interrogation without counsel.
At the same time, the lawyers designated by the relatives of some of the detainees were prevented from doing their job and denied access to two of the detainees. Denying the visit and to be able to know the accusations. In this sense, the Guardia Civil has prevented the attorney team from assisting two of the detainees and have been assigned with a public defender.
Valuations about the operation
From Alerta Solidària @AlertaSolidaria, this operation is valued as an operation of political and electoral type with a double will: on the one hand to make electoralism a few weeks before the repeated general elections in Spain and on the other hand to try to stop the next mobilisations around October 1st and the trial’s verdict against the Catalan political prisoners.
The constant leaks by Spanish judicial institutions and police denote a dirty war that has much more to do with a media pulse against independence than with a judicial process underway.
Finally, it is found that, despite the attempts of criminalisation, demobilisation, and isolation that are aimed at this operation, the response of the population has been mobilisation and solidarity. Only by continuing with the mobilisations of support, the rejection of repression and the fight for the freedom of our people we will be able to stop this and so many other repressive hits.

Less and less Catalans want to live in a country like Spain where power is seized and maintained by force since Franco dictatorship. Even if you are far from this conflict, I consider you are an informed person that understands perfectly well that when there is a problem of these characteristics, the most reasonable is dialogue, negotiation, and, if appropriate, the Polls.

Madame, Monsieur,
Je suis XXX, un(e) citoyen(ne) Catalan(e) profondément préoccupé(e) par ce qui se passe dans mon pays. La résistance naît lorsque des actes de répression sont la réponse à des mouvements pacifiques.
Le 23 Septembre 2019, neuf membres des CDR (Comités de Défense de la République) ont été arrêtés par la police espagnole. Ceci est une nouvelle tentative d’intimidation et de criminalisation du mouvement pour la souveraineté de la Catalogne ((tel que l’explique Raphael Tsavkko Garcia @Tsavkko_intl dans son article
Les douze prisonniers politiques ont finalement été condamnés pour leur participation à la préparation du référendum d’indépendance (le 1er octobre 2017), selon le mandat populaire du peuple Catalan.
L’Audience Nationale espagnole (cour pénale) https://fr.wikipedia.org/wiki/Audience_nationale a pris en charge cette affaire parce qu’ils ont considéré qu’il s’agissait d’un délit étatique. Les chefs d’accusation initiaux étaient le terrorisme, la rébellion et la possession d’explosifs, ce dernier a été abandonné après qu’ils se sont rendu compte qu’ils n’avaient saisi que des pétards d’une festivité locale. Mais sept parmi eux ont été envoyés en prison sans caution accusés d’appartenance à une organisation terroriste.
Selon Alerta Solidària @AlertaSolidaria (l’équipe de défense juridique), les suivantes irrégularités ont été commises jusqu’à présent :

Atteinte au droit de défense
Pendant ces deux jours, l’équipe de défense a subi de nombreuses difficultés exercées à bon escient par plusieurs parties, la Guardia Civil, le procureur et l’Audience Nationale, qui ont provoqué de sérieuses violations des droits des activistes Catalans :
D’abord, il y a eu des fuites d’information aux médias de ses propres opérations, supposés accusations, supposés éléments trouvés lors de la perquisition, etc.; dans une affaire dans laquelle la défense ne peut pas avoir accès dû au fait qu’elle est sous le sceau du secret. D’un autre côté, l’équipe d’avocats ont expérimenté des difficultés pour savoir où se trouvaient les détenus, puisqu’ils n’étaient pas informés ou seulement avec des renseignements contradictoires.
Les avocats ont aussi trouvé des difficultés à s’entretenir avec les détenus, qui ont fait plus de 36 heures d’interrogatoire sans conseil.
En même temps, les avocats choisis par les parents de certains détenus ont été empêchés de faire leur travail et privés d’accès à deux des détenus. Ils n’ont pas pu connaître les accusations. Dans ce sens, la Guardia Civil a empêché l’équipe de défense d’assister deux des détenus et on leur a assigné un avocat commis d’office.
Evaluation de l’opération
Depuis Alerta Solidària @AlertaSolidaria, cette opération est estimée une opération de type politique et électorale à double finalité : d’un côté, faire de l’électoralisme quelques semaines avant la répétition des élections en Espagne et, d’un autre, essayer d’arrêter les prochaines mobilisations autour du 1er octobre et le verdict contre les prisonniers politiques Catalans.
Les fuites constantes des juridictions espagnoles et de la police dénotent une guerre sale qui a beaucoup plus à voir avec un pouls contre l’indépendance qu’avec un procès juridique en cours.
Enfin, il est considéré que, malgré les tentatives de criminalisation, démobilisation et isolement poursuivis avec cette opération, la réponse de la population a été la mobilisation et la solidarité. Seulement avec les mobilisations de soutien, le rejet de la répression et la lutte pour la libération de notre peuple, nous pourrons arrêter ceci ainsi que bien d’autres coups de répression.

De moins en mois de Catalans souhaitent vivre dans une Espagne où le pouvoir est pris et maintenu par la force depuis la dictature de Franco. Même si vous êtes étranger à ce conflit, je vous considère une personne informée qui comprend parfaitement bien que, lorsqu’il y a un problème de ces caractéristiques, la chose la plus raisonnable est le dialogue, la négociation et, s’il est nécessaire, les Urnes.
